FORM's TERMS & CONDITIONS

1.1 Acceptance of terms of usage

 

By accessing, browsing, and/or using the Site and/or any facility operated by “FORM”, you accept and agree to be bound to these Terms. In addition, when using particular FORM services, you also shall be subject to any posted guidelines, FAQs, or rules applicable to such services, which may be posted and modified from time to time.

 

1.2 Rules, Regulations and Schedules

 

Members agree to abide by all the membership rules, regulations and schedules of the facility, which may be posted at the facility or issued verbally, and which may be amended from time to time, at FORM’s sole discretion.

 

1.3 Valuables and Personal Property 

 

Members are urged to avoid bringing valuables onto the premises. FORM shall not be liable for the loss of, theft of or damage to the personal property of members or guests, including items left in lockers, with the front desk or anywhere else at FORM.

 

1.4 Photography & Video

 

We allow and welcome members to take handheld photography and video footage at FORM but please be mindful of the privacy of others.

 

Members are not permitted to record or transmit (video, audio, still photography, streaming, social media posting, etc.) of live FORM classes or activities, whether in person or online.

 

FORM, from time to time, may video or photograph sessions and use these images and videos on FORM social media or online. We will always verbally check with the class or individual. Please verbally let the coach know if you’d rather not feature in these videos or photos.

 

1.5 Independent Contractors 

 

FORM may make available to members and the services of independent contractors. We will do our best in sourcing independent contractors that we believe are able to provide a good service to our members, but we do not warrant or guarantee the quality of these services, and hereby disclaim all liability arising out of such services.

 

1.6 Unauthorized Trainers

 

Use of non-FORM trainers in the facility is prohibited. Members may not personally train other members.


1.7 Suspension of Access or Services

 

Members will not be permitted to use any FORM services until all fees are current. If balances are overdue, then FORM reserves the right to suspend access or services. FORM reserves the right to charge balances and overdue balances. 

 

1.8 Revocation of Membership

 

FORM reserves the right to revoke and cancel any member's membership at any time for any reason, in which case, FORM will immediately terminate any monthly payments of the member. FORM reserves the right to retain expenses incurred or the portion of the total price of this Agreement representing the services used or completed, and provided further, that FORM may demand the reasonable cost of goods and services which the Member has consumed or wishes to retain after cancellation.

 

1.9 Payment Policy

 

We ask that all payments are paid in full before starting training. All invoices will be issued in USD, but we also accept payments in local MMK currency. If you wish to pay in MMK we will charge you the USD equivalent based on the Central Banks exchange rate for that day.

 

We accept payments via Visa Card, KBZ bank transfer, KBZ Pay or cash.

 

We offer split payment options for the following packages:

 

  • 3 month / 12 weeks / 10 session packages: 2 payments 

  • 6 months / 24 weeks / 25 session packages: 3 payments

  • 12 month packages:  4 payments

 

2.0 Refund Policy

 

We do not offer refunds on our packages, unused sessions or expired sessions and all purchases are final. 

 

2.1 Transferring Packages

 

In the case of relocation or long-term injury, we can transfer your package to someone else as long as the package is within the expiry period and the remaining sessions are used. The decision to transfer packages will be under management's sole discretion.

 

2.2 Group Class Cancellation Policy

 

Our group class training cancellation policy is 12 hours. Any classes cancelled less than 12 hours before the class start time, will have a session deducted from their package and be charged full price..

 

Classes can be cancelled through calling our front desk or by sending an email to enquire@formyangon.com . This must be done more than 12 hours before the class start time.

 

2.3 Group Class Lateness Policy

 

We cannot guarantee entry into the class if you arrive at FORM after the class has started. We ask that you arrive at FORM at least 15 minutes before the session to get yourself set up.

 

We cannot, under any circumstances, let a member join the class after the warm up has started – this is for the safety of all members. 

 

If you are late and have not notified the front desk, your spot will be given to anyone on the waiting list in the case of a full class.

 

2.4 Personal Training Cancellation Policy

 

Our personal training cancellation policy is 24 hours. Any personal training sessions that are cancelled with less than 24 hours’ notice will be charged as one full session. Please kindly understand that late cancelled sessions result in the Coach missing the chance to train another client.

 

Our Coaches will always make an effort to reschedule the personal training session on the same day if possible. If it cannot be rescheduled for the same day then the session will be charged.

 

Sessions cancelled more than 24 hours before the session start time by calling the front desk or messaging/calling your Coach directly will not be charged.

 

2.5 Personal Training Lateness Policy

 

If you are running late for your personal training session please message your Coach directly or call our front desk. When you arrive, your session will have already started so your Coach may need to adjust your program to fit the remaining time of your session. Your Coach will not be able to extend your session due to other client bookings and studio bookings. 

 

If you are running late for your session and have not contacted either your Coach or our front desk, your Coach will wait for 15 minutes and no longer. Any longer than 15 minutes late will be considered a ‘no show’ and you will be charged for a full session. 

 

To avoid reducing your training time, please arrive at FORM at least 15 minutes before the session to get yourself set up.

 

2.6 Small Group Personal Training Cancellation Policy

 

Please kindly note that our small group personal training cancellation policy is 24 hours. Any small group personal training sessions that are cancelled with less than 24 hours’ notice will be charged as one full session. Please kindly understand that late cancelled sessions result in the Coach missing the chance to train another client.

 

Our Coaches will always make an effort to reschedule the small group personal training session on the same day if possible. If it cannot be rescheduled for the same day then the session will be charged.

 

Sessions cancelled more than 24 hours before the session start time by calling the front desk or messaging/calling your Coach directly will not be charged.

 

2.7 Small Group Personal Training Lateness Policy

 

If you are running late for your small group personal training session please message your Coach directly or call our front desk. As soon as your session start time begins, whoever is present will begin the session with the Coach regardless of other participants' lateness. If group members arrive late, your session will have already started so your Coach may need to adjust your program to fit the remaining time of your session. Your Coach will not be able to extend your session due to other client bookings and studio bookings. 

 

Even if not all members are present for a used session, it will still be counted as a completed full session - sessions cannot be split.

 

If you are running late for your session and have not contacted either your Coach or our front desk, your Coach will wait for 15 minutes and no longer. Any longer than 15 minutes late will be considered a ‘no show’ and you will be charged for a full session. 

 

To avoid reducing your training time, please arrive at FORM at least 15 minutes before the session to get yourself set up. 

 

We  strongly recommend only entering into a small group personal training program with equally committed members.

 

2.8 Personal Training Package Expiry

 

All packages will be activated on the day of the first session attended. This must be within 1 month of purchase. If no sessions have been attended after 1 month from purchase, the package will automatically be activated.

 

Personal training package expiry times;

 

  • 12 week packages = 12 week expiry

  • 24 week packages = 24 week expiry

  • 1 session flexible package = 1 month expiry

  • 10 session flexible package  = 3 months expiry

  • 25 session flexible package  = 6 months expiry

 

2.9 Group Training Package Expiry

 

All packages will be activated on the day of the first session attended. This must be within 1 month of purchase. If no sessions have been attended after 1 month from purchase, the package will automatically be activated.

 

Group training package expiry times;

 

  • 1 month packages = 1 month expiry

  • 3 month packages = 3 month expiry

  • 6 month packages = 6 month expiry

  • 12 month packages = 12 month expiry

  • 1 session flexible package = 1 month expiry

  • 10 session flexible package  = 2 months expiry

  • 25 session flexible package  = 4 months expiry

 

3.0 Package Freeze Policy

 

We offer freezes on our packages for a minimum of 7 days and a maximum of 30 days for: Injury, sickness or leave from Yangon only.  We must be told of the freeze before it happens by email to enquire@formyangon.com or providing our front desk with written notice. Please kindly note that we cannot freeze packages after the requested dates under any circumstances. We can only freeze packages ahead of time.

 

Once the date(s) of a freeze has been agreed, the freeze cannot be extended. In the case that you wish to extend the time the package is frozen, it will need to be done as an additional freeze of 7 days or more, and will be counted as another freeze on your package (as long as your package has another applicable freeze).

 

The freezes permitted on each package are as follows;

 

  • 1 month / starter packs / 1 session packages: Cannot be frozen

  • 3 months / 12 weeks / 10 session package: 1 freeze of 7-30 days

  • 6 months / 24 weeks / 25 session package: 2 freezes of 7-30 days

  • 12 months: 3 freezes of 7-30 days

 

In the case of injury or sickness, please provide a medical certificate and we will freeze your account without it counting towards your permitted freezes. Please provide the medical certificate within 7 days of your sickness. Freezes for sickness without a medical certificate will count towards one of your permitted freezes.

3.1 Health and Safety Policy

 

We take our Health and Safety Policy extremely seriously at FORM, and pride ourselves on doing all we can to make sure you have a safe and secure environment to train in.

 

We have a certified First Aider and CPR responder onsite during all opening hours. We also have International Standard First Aid Kits available on every floor. 

 

We ask that you notify your Coach if, during the course of training, your medications, condition, or medical limitations should change. We also highly suggest that you have a frequent physical examination and consult your physician before starting any training.

 

3.2 Privacy Policy

 

At FORM we are committed to safeguarding and preserving the privacy of all our members and their personal information. We may collect and process the following data about you:

 

  • Information provided voluntarily by you. For example, when you register for information or make a purchase.

  • Information that you provide when you communicate with us by any means.

  • Information about your use of our site including details of your visits such as pages viewed and the resources that you access.

 

We will not disclose your information to any other party than in accordance with this Privacy Policy or in the circumstances where we are legally required by law, or to further fraud protection and reduce the risk of fraud.

 

We update this Policy from time to time so please do review this Policy regularly.
